The relationship between an employer and an employee, from recruitment to retirement, is subject to Statute Law and is impacted by the decisions of courts and tribunals. Ireland is one of Europe’s most highly regulated employment environments and it is imperative for anyone running a small to medium business, or working in a HR capacity, to avoid the costly pitfalls and frequent mistakes made in this area. This module gives an introduction to the principal areas of employment law that affects business in Ireland today.

Entry to this course is by direct application to the college. There are no previous academic requirements.

Class Sizes

We are committed to ensuring you gain the most, academically and personally, during your study time with Portobello.  To facilitate this, we limit our class sizes to a maximum of 14 students on part-time programmes. With these uniquely small classes, we create the environment for you get to know everyone in your group, you can then feel comfortable and confident to ask questions and our tutors have the time to attend to the needs of each and every student. This part time course is delivered one evening a week over 10 weeks

Course Content Modules

Detailed below is a summary of the content covered.

•    Principal features of a contract of employment and the various terms contained within, including understanding the difference between a contract of service and a contract for services.
•    Understand employee rights including minimum wages, minimum notice, leave entitlements, terms of employment and employer and employee duties under common law
•    Evaluate individual employment rights concepts including discrimination, maternity, adoptive and parental leave, part-time and fixed term work, agency work, payment of wages, organisation of working time, pensions, health and safety, equality and privacy.
•    Understand the main provisions of the current Unfair Dismissals legislation, Constitutional and European Rights of employees and the procedure for taking a claim under legislation for unfair dismissals.
•    Identify Dispute Resolution mechanisms including the role and function of industrial relations bodies
•    Explore the main provisions of Safety, Health and Welfare legislation as it pertains to employers and employees
•    Understand employment rights pertaining to pensions and redundancies
•    Understand the implications of Data Protection and the Freedom of Information legislation in the workplace.

Further Study

This module is part of the QQI Level 6 Major Award (6M4587) in Management and contributes 15 credits towards achieving this award. Learners can study this programme as a single award or can use it towards the 120 credits required for the major award.
